Partner of Antika Law Firm, Ph.D. Maxim Korchagin and lawyer Mykhailo Voitsekhovskyi told the experts from Persha Insurance Company about peculiarities of liability for damage caused by a source of high risk.
Lawyers of Antika held the training for the colleagues from Persha Insurance Company, which provided answers to the most complex questions that arise when compensating for damage caused by vehicles. In particular, they talked about:
- general and special rules for compensation for damage;
- interpretation of the concept of “irresistible force” in the sense of Part 5 of Art. 1187 of the Civil Code of Ukraine;
- sources on proving circumstances of irresistible force;
- peculiarities of certification of circumstances of irresistible force by The Ukrainian Chamber of Commerce and Industry;
- criminal intent of the injured person for the purposes of Part 5 of Art. 1187 of the Civil Code of Ukraine and possible ways of its proving;
- the consequences of the gross negligence of the injured person;
- peculiarities of determining the amount of moral harm caused by the source of increased danger.
During the training, there also a number of non-trivial practical cases were considered, and the issues most often faced by specialists from Persha Insurance Company were discussed.

The materials for the insured event first reach them at the time of applying for compensation for damages, when the circumstances of the event have already been established by another jurisdiction.
