Alexey Kot, Doctor of Law, Managing partner of Antika Law Firm and Alexander Tretiakov, Senior Associate of Antika Law Firm held a workshop on “Protection of trade secret” for the companies representative-members of American Chamber of Commerce in Ukraine.
Disclosure of a trade secret can cause great harm to business. Although, it is not easy to punish employees who disclose a trade secrets. Such employee cannot be fined because it is considered a disciplinary sanction, which can be applied only in cases provided for by law. There is a chance to receive compensation equivalent to the caused damage. A very effective element of trade secret protection can be an appeal to the AMCU.
During the workshop “Protection of trade secret” the lawyers of Antika told the following:
- What information can be considered a trade secret;
- How to protect a trade secret: basic methods and nuances of protection;
- Responsibility for the disclosure of a trade secret: how to prove that a violation was committed and punish a law violator;
- Analysing of successful cases of bringing to responsibility for unlawful use of trade secret;
- Appeal to the AMCU: how to prepare a complaint, the basic rules for its submission.
