Partners of Antika Law Firm Alexey Kot and Andrey Kuznetsov attended the 2nd Annual Judicial and Legal Forum

On April 18, 2014 the Supreme Court of Ukraine hosted the 2nd Annual Judicial and Legal Forum. The Forum included three parallel sessions devoted to criminal, administrative, civil and commercial proceedings with further discussion of the most topical issues on working meetings.

During the session devoted to criminal proceeding the speakers among which there were the judges of the Higher Specialized Court of Ukraine for Civil and Criminal Cases , legal practitioners and advocates, determined the problem points arise from applying criminal proceedings security measures and unstated investigative actions according to the new Criminal Procedural Code of Ukraine, discussed issues of international criminal prosecution, awarding sentences on the basis of agreements, as well as tried to define if it is real for the parties of the criminal proceeding to have equal possibility for evidence collection.

The session devoted to administrative proceeding included topics related to court practice according to the new Tax Code, the latest patterns of tax audit report appeals and revocation of right of VAT tax payer or unreimbursed VAT. The participants also discussed the reasonability and prospects of considering tax disputes in the European Court of Human Rights.

The participants of the session devoted to civil and commercial proceedings paid attention to issues related to the role and tasks of the Higher Specialized Court of Ukraine in terms of present cassational proceeding, implementation of European standards to Ukrainian legal proceedings, as well as problematic issues related to debt recovery on loan agreements, recovery proceedings against property rights, compensation of court costs in the commercial proceedings.
