The partner of the Antika Law Firm Maxim Korchagin took part in the discussion of the nuances of the legal representation according to the new Economic Procedure Code of Ukraine

Partner of the Antika Law Firm Maxim Korchagin came out with an expert opinion on the LHS Discussion Hub on the topic “Admission of an attorney to participate in the economic process.” The event took place on August 20, 2018 at the Legal High School.

Lawyers and judicial authority representatives took part in the discussion. Within the framework of the meeting, the features of the self-representation of the legal entity (the attitude of the Grand Chamber of the Supreme Court), confirmation of the representative’s authority in the economic process and other issues were discussed.

“One of the debating points can be considered a self-representation of a legal entity. The roots of this problem are due to the traditional approach of courts to equating the body of a legal entity to a representative, in particular when approving a transaction.

 The new procedural legislation in this matter is ambiguous, however, if the participation in the process of the director as a legal entity body from a representative is clearly delineated, collisions will be avoided. If we talk about the regulations of the current Economic Procedure Code of Ukraine, the director has the opportunity to participate in the process on behalf of the legal entity without a lawyer, “- explained the partner of the Antika Law Firm, Maxim Korchagin.
