ANTIKA’S MANAGING PARTNER ALEXEY KOT TOOK PART IN THE DISCUSSION “IS THERE A FUTURE IN THE ECONOMIC CODE OF UKRAINE?”

Yesterday, March 12, Legal High School hosted another Discussion Hub on “Is there a future in the Commercial Code of Ukraine?”. Among the experts who expressed their expert opinion on this issue was also the managing partner of Antika Law Firm, a member of the Judicial Reform Council under the President of Ukraine, Doctor of Law Alexey Kot.

For more than 15 years, the Civil and Economic Codes of Ukraine have existed side by side. This has always provoked a lot of discussions: on the priority of norms, the distribution of spheres of regulation and, most importantly, whether Ukraine’s economy can exist without the regulation of the Economic Code of Ukraine.

“The results of research show that up to 70% of the provisions of the Economic Code are reference or blanket. If we analyze the content of decisions and rulings of courts of economic jurisdiction, the component of the articles of the Economic Code, which are referred to by judges in their decisions, is insignificant“,- said the managing partner of Antika, Doctor in Law, Alexey Kot.

During LHS DiscussionHub, legal experts tried to find answers to a number of controversial questions:

The place of the Civil Code of Ukraine in the system of legislative acts regulating economic activity in Ukraine;

The results of a study of the legal regulation of the economy in European countries;

Ukraine and Kazakhstan: the only countries in the post-Soviet territory where there is a separate code for regulating economic relations;

 How could economic legal relations develop in Ukraine if there was no Economic Code of Ukraine?
